TERMS & CONDITIONS — NewSouth Renovations LLC

These Terms & Conditions (“Terms”) govern your access to and use of the website and services provided by NewSouth Renovations LLC (“Company,” “we,” “us,” “our”), including residential and commercial renovation services, remodeling, water damage repair, and insurance claim coordination.

By accessing or using our website or services, you agree to be bound by these Terms.

1. ELIGIBILITY (AGE REQUIREMENT)

Our services are intended for individuals who are 18 years of age or older. By using our website or services, you represent and warrant that you are at least 18 years old.

2. USE OF WEBSITE

You agree to use this website only for lawful purposes. You may not:

  • interfere with website functionality or security

  • attempt unauthorized access

  • copy, scrape, or reproduce content

  • introduce malicious code or harmful software

3. NO PROFESSIONAL OR LEGAL ADVICE

All information provided on this website is for general informational purposes only and does not constitute legal, insurance, engineering, or professional advice.

4. ESTIMATES & PROJECT SCOPE

All estimates are preliminary and non-binding and are based on initial information provided by the customer.

Final pricing, scope, and timelines may change due to:

  • hidden or unforeseen site conditions

  • structural or code compliance issues

  • permit or inspection requirements

  • material availability or price changes

  • measurement discrepancies

  • customer-requested changes or additions

  • access limitations or job site conditions

Only a written, signed agreement, contract, or work order shall define the final scope, pricing, and schedule.

5. CUSTOMER RESPONSIBILITIES

You agree to:

  • provide accurate and complete information

  • ensure safe and timely access to the property

  • secure personal belongings, valuables, and pets

  • disclose known or suspected hazards (including mold, asbestos, lead paint, structural damage, or electrical issues)

  • respond to approvals and decisions in a timely manner

Failure to disclose relevant conditions may result in delays or additional costs.

6. INSURANCE CLAIMS (NO GUARANTEE)

We may assist with documentation, estimates, and coordination related to insurance claims.

However, we do not:

  • guarantee insurance approval

  • guarantee coverage amounts

  • guarantee payment from insurance carriers

  • control insurance timelines or decisions

All insurance coverage decisions, approvals, and payments are made solely by the insurance provider and are outside of our control.

Unless otherwise agreed in writing, the customer remains responsible for all payments, including deductibles and any amounts not covered by insurance.

7. PAYMENTS

Payment terms are outlined in your invoice or contract.

Failure to make timely payments may result in:

  • suspension or delay of work

  • late fees where permitted by law

  • collection actions

You agree to raise any billing disputes in writing before initiating chargebacks.

8. SUBCONTRACTORS

We may engage subcontractors or third-party professionals to perform portions of the work. We remain responsible for overall project coordination unless otherwise stated in writing.

9. SCHEDULING & DELAYS (FORCE MAJEURE)

Project timelines are estimates only.

We are not liable for delays caused by:

  • weather conditions

  • permit or inspection delays

  • material shortages or supply chain disruptions

  • labor or subcontractor availability

  • utility outages

  • acts of God or events beyond reasonable control

10. WARRANTY

Any warranty is valid only if explicitly stated in a written agreement.

Warranties do not cover:

  • normal wear and tear

  • misuse or lack of maintenance

  • pre-existing conditions

  • third-party modifications or work

  • manufacturer defects (covered by manufacturer warranties)

11. LIMITATION OF LIABILITY

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits or business interruption.

Our total liability for any claim shall not exceed the total amount paid for the specific service giving rise to the claim (or $100 if no payment has been made).

12. INDEMNIFICATION

You agree to indemnify and hold harmless the Company from any claims, damages, liabilities, or expenses arising from:

  • your misuse of the website or services

  • violation of these Terms

  • infringement of third-party rights

  • inaccurate information provided by you

13. PHOTOS, CONTENT & PROJECT MATERIALS

You represent that you have the right to share any photos, videos, or documents provided to us.

We may use such materials for estimating, project execution, and internal documentation.

Marketing use (before/after photos) will only occur with your consent where required by law.

14. DISPUTE RESOLUTION; BINDING ARBITRATION; CLASS ACTION WAIVER

To the maximum extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms, the website, or the services shall be resolved through binding arbitration, rather than in court, except where a claim qualifies for small claims court.

Arbitration shall be conducted on an individual basis only. You agree that you waive the right to participate in any class action, class arbitration, or representative proceeding.

The arbitrator shall have authority to award relief only to the individual party and only to the extent necessary to resolve the individual claim.

15. GOVERNING LAW

These Terms are governed by the laws of the State of North Carolina and applicable federal laws of the United States, without regard to conflict of law principles.

16. VENUE (LIMITED COURT JURISDICTION)

Any court proceedings permitted under these Terms (including enforcement of arbitration awards or eligible small claims matters) shall be brought exclusively in the state or federal courts located in Mecklenburg County, North Carolina, and you consent to jurisdiction and venue in such courts.

17. CHANGES TO TERMS

We reserve the right to update or modify these Terms at any time by posting a revised version on this page with an updated “Last Updated” date. Continued use of the website or services constitutes acceptance of such changes.
